Complying With The Federal Credit Reporting Act
What Employers Need To Know
Employers using background investigations for employment purposes must comply with the Fair
Credit Reporting Act (FCRA).
- Give a written disclosure to the subject, separate from the application, that a
background investigation may be conducted prior to requesting the background report.
- Obtain the written authorization of the applicant/employee before you request a background report.
- If any adverse employment action is taken based in whole or in part upon the background investigation,
you must provide the subject with a notice before the adverse action. This notice must include:
- A copy of the background investigation report.
- A summary of the applicant's rights under the FCRA.
- After providing this information to the subject, the employer must wait approximately five days before
actually taking the adverse action.
- Upon taking the adverse action, you must provide:
- Notice of the adverse action being taken.
- The name, address and toll-free number of the background investigation company that provided the report.
- A statement that the background investigation company did not make the decision for adverse action and is
unable to provide the subject the specific reasons why the adverse action was taken.
- Notice of the subject's right to obtain a free copy of the background report from the background
investigation company within 60 days.
- Notice of the consumer's right to dispute the accuracy or completeness of any information in the background
report.
